Terms of service

Welcome to Callsy. Callsy is operated by Callsy AI OÜ, a private limited company incorporated in the Republic of Estonia ("Callsy", "we", "us"). Callsy provides AI voice, SMS, and email agents that help businesses ("Merchants", "you") communicate with their customers across sales, recovery, booking, and support workflows, on Shopify, WooCommerce, and other platforms and integrations. By using our services you agree to comply with and be bound by these terms of service. Please read them carefully.

Use of Services

Eligibility

To use Callsy.ai, you must:

  • Be at least 18 years old.
  • Have a valid account on a supported platform, or use Callsy through a supported integration or API.
  • Agree to these terms and all applicable laws and regulations. -

AI Disclosure:

The Merchant acknowledges that the Services utilize Artificial Intelligence to generate voice responses. In compliance with the EU AI Act, the Merchant agrees that all AI Agents configured via the Service shall be programmed to disclose their non-human nature to the End User at the commencement of the call (e.g., 'I am X an AI assistant calling from...').

Account Registration

You must provide accurate and complete information when registering for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Services Provided

Callsy provides AI voice, SMS, and email agents and related tools that businesses use to communicate with their customers, including:

  • AI Voice Agents: Automated inbound and outbound calls that recover abandoned carts, confirm orders and cash-on-delivery, book and remind about appointments, qualify leads, win back customers, and answer customer questions, in the Merchant's brand voice.
  • SMS and Email Agents: Follow-up and re-engagement messages across SMS and email.
  • Personalization and Reporting: Tailored offers based on customer behavior, plus analytics, transcripts, and reporting.

The specific channels, use cases, and integrations available may change over time as the Services evolve.

The Merchant acknowledges that the Services utilize Artificial Intelligence to generate voice responses. In compliance with the EU AI Act, the Merchant agrees that all AI Agents configured via the Service shall be programmed to disclose their non-human nature to the End User at the commencement of the call (e.g., 'I am an AI assistant calling from...')

Merchant Responsibilities

As a merchant using Callsy.ai, you agree to:

  • Provide accurate and up-to-date information about your products and pricing.
  • Ensure that your use of our services complies with all applicable laws and regulations.
  • Not use our services for any unlawful or fraudulent activities.
  • Understand and comply with all legal restrictions in the markets where you operate, including regulations regarding unsolicited communication to customers.

Unsolicited Communication

Merchants are solely responsible for ensuring that any communication with their customers, including but not limited to calls made by our AI agent, complies with all applicable laws and regulations regarding unsolicited communication. This includes obtaining necessary consents and providing any required notices. Callsy.ai is not responsible for any claims, damages, or legal actions arising from unsolicited communication conducted by merchants using our services. Merchants bear all legal implications and liabilities in the event of such claims.

Telephony, Recording and Communications Compliance

Because the Services place calls and send messages to your customers, you represent, warrant, and agree that, for every contact you initiate or enable through Callsy, you will:

  • Have a valid lawful basis and any prior consent required to contact the End User by automated or AI-generated voice, SMS, or email.
  • Comply with all applicable telemarketing, robocall and automated-dialing, call-recording and call-monitoring consent, do-not-call / suppression-list, calling-time, and e-privacy laws (including, where applicable, the GDPR, the ePrivacy Directive / PECR, the US TCPA, and the EU AI Act).
  • Honour opt-outs and do-not-contact requests promptly, and not contact any number on an applicable do-not-call or suppression list.
  • Provide any disclosures required where calls are recorded, and ensure your AI Agents disclose their non-human nature to the End User as required by the EU AI Act.

You are solely responsible for the content of your scripts, messages, prompts, and contact lists. Callsy provides tools, not legal advice, and does not verify that your communications are permitted. You assume all risk and liability arising from the communications you send through the Services.

Customer Data

By using our services, you authorize Callsy.ai to access and use the following data:

  • User Data: Contact information, shopping cart details, and purchase history.
  • Merchant Data: Store information, product catalog, pricing, and discount codes.

Data Sharing

We may share necessary data with third-party applications to enhance our AI capabilities. We ensure that all third-party services adhere to strict privacy standards.

Intellectual Property

All content and materials available on Callsy.ai, including but not limited to text, graphics, website name, code, images, and logos, are the intellectual property of Callsy.ai and are protected by applicable copyright and trademark law. Any inappropriate use, including but not limited to the reproduction, distribution, display, or transmission of any content on this site, is strictly prohibited unless specifically authorized by Callsy.ai.

Termination

We reserve the right to terminate or suspend your account and access to our services at our sole discretion, without prior notice, for conduct that we believe violates these terms or is harmful to other users, us, or third parties, or for any other reason.

Warranties and Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or that the Services will be uninterrupted, secure, timely, or error-free. We do not warrant any specific uptime or service level unless agreed in a separate written agreement. You use the Services at your own risk.

AI Output and No Guarantee of Results

The Services use Artificial Intelligence, which is probabilistic and may produce output that is inaccurate, incomplete, delayed, or unexpected. You are responsible for configuring your AI Agents, reviewing and approving your scripts and prompts, and monitoring the Services. Any performance figures, recovery rates, revenue estimates, benchmarks, or similar statements (including on our website or in our marketing) are illustrative only, are not promises, and do not constitute a warranty or guarantee of any particular result. Results depend on factors outside our control, including your products, pricing, audience, and compliance.

Limitation of Liability

To the maximum extent permitted by law, Callsy.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use the service.
  • Any unauthorized access to or use of our servers and/or any personal information stored therein.
  • Any interruption or cessation of transmission to or from our services.
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party.
  • Any claims, damages, or legal actions arising from unsolicited communication conducted by merchants using our services.

In all cases, and to the maximum extent permitted by law, Callsy's total aggregate liability for all claims arising out of or relating to the Services or these terms shall not exceed the greater of (a) the total fees you paid to Callsy in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred euros (EUR 100). Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.

Indemnification

You agree to indemnify and hold Callsy.ai and its subsidiaries, affiliates, officers, agents, employees, partners, and licensors harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the service, your violation of these terms, your violation of any rights of another, or any claims, damages, or legal actions arising from unsolicited communication conducted by you using our services. This includes, without limitation, any claim arising from your scripts, messages, prompts, or contact lists, your failure to obtain any required consent, or your violation of any telemarketing, robocall, call-recording, do-not-call, e-privacy, data-protection, AI, or consumer-protection law.

Data Processing Addendum (DPA)

By installing, accessing, or using the Callsy platform, app, or Services, the Merchant (Controller) accepts and enters into the Data Processing Agreement (DPA) incorporated herein by reference.

The DPA between Callsy AI (Processor) and the Merchant (Controller) becomes effective automatically at the moment the Merchant first installs, accesses, or uses the Services. No additional signatures are required under Article 28 of the GDPR.

Changes to These Terms

We may update these terms from time to time to reflect changes in our practices or legal requirements. We will notify you of any significant changes by posting the updated terms on our website and, if necessary, through other communication channels. Your continued use of our services after any changes have been made constitutes your acceptance of the new terms.

Governing Law

These terms are governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict-of-law principles. The courts of Estonia shall have exclusive jurisdiction over any dispute arising out of or relating to these terms or the Services, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.
